2. Agreement to Terms

By accessing, purchasing from, or using this website, programs, subscriptions, digital content, coaching services, supplements, or related offerings (“Services”), you agree to be bound by these Terms. If you do not agree, do not use the Services.

3. Nature of Services & Medical Disclaimer

SOMA Functional Health LLC provides educational, coaching, wellness, and lifestyle support services.

IMPORTANT:

  • We do not diagnose, treat, cure, or prevent disease.

  • Services do not constitute medical advice.

  • Participation does not establish a doctor–patient relationship unless explicitly stated in writing.

  • You are responsible for consulting licensed healthcare providers regarding medical decisions.

All recommendations are for educational purposes only and are implemented at your own discretion and risk

4. Health Information & HIPAA Notice

We may collect health-related information to support coaching and wellness services.

SOMA intends to operate in a HIPAA-aligned manner and uses reasonable administrative, technical, and physical safeguards to protect health information. However:

  • Not all data collected is subject to HIPAA

  • HIPAA protections apply only where legally required and contractually established

By using our Services, you consent to the collection, use, and storage of health-related information as described.

5. Privacy & Data Use

We collect personal, payment, and health-related information as outlined in our Privacy practices.

We use third-party providers including:

  • Shopify (e-commerce)

  • Stripe (payments)

  • HighLevel (CRM & email)

  • Google Analytics

  • Meta (Facebook/Instagram tracking)

We do not sell personal data. International users consent to data processing in the United States.

6. Eligibility & Minors

Users under 18 may access Services only with parental or legal guardian consent. Guardians assume responsibility for any data provided by minors.

7. Payments, Subscriptions & Billing

  • Payments are processed securely through Shopify and Stripe

  • Subscriptions renew automatically unless canceled

  • You authorize recurring charges where applicable

  • Prices are listed in USD unless otherwise stated

Failure to pay may result in suspension or termination of access.

8. Refund & Cancellation Policy

Due to the nature of digital products, coaching, and personalized services:

  • All sales are final unless otherwise stated

  • Refunds are issued only if explicitly offered in writing at the time of purchase

  • Subscription cancellations stop future charges but do not retroactively refund prior billing periods

Chargebacks without contacting support may result in immediate termination of access.

9. Shipping Policy (Physical Products)

For physical products such as supplements:

  • Shipping timelines are estimates, not guarantees

  • International orders may be subject to customs fees or delays

  • SOMA is not responsible for customs duties, lost packages once marked delivered, or carrier delays

10. Intellectual Property

All content, programs, branding, trademarks, and materials are the exclusive property of SOMA Functional Health LLC.

You may not reproduce, distribute, resell, or modify content without written permission.

11. Acceptable Use

You agree not to:

  • Misuse Services

  • Share or resell access

  • Provide false information

  • Violate laws or regulations

  • Interfere with platform security

Violations may result in termination without refund.

12. Assumption of Risk & Waiver of Liability

You voluntarily assume all risks associated with participation in wellness, lifestyle, or health-related programs.

To the maximum extent permitted by law, you release SOMA Functional Health LLC from any liability arising from:

  • Program participation

  • Use of recommendations

  • Physical or emotional outcomes

13. Disclaimer of Warranties

Services are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose.

14. Limitation of Liability

SOMA’s total liability shall not exceed the amount paid by you for the Services giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless SOMA, its owners, employees, contractors, and affiliates from any claims arising from your use of Services or violation of these Terms.

16. Termination

We reserve the right to terminate access at our discretion for violations of these Terms or misuse of Services.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States.

18. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
